1. Definitions

For the purposes of these Terms and Conditions:

• "We," "Us," "Our" refers to Gentle Tides, the residential care home operating at 142 Moo 2, Rawai, Muang Phuket, Phuket 83130, Thailand.
• "Resident" refers to any individual receiving residential care services from Gentle Tides.
• "Family Member" or "Representative" refers to the resident's legal representative, designated family contact, or authorized decision-maker.
• "Services" refers to all residential care, support, accommodation, meals, activities, and related services provided by Gentle Tides.
• "Agreement" refers to the contract entered into between Gentle Tides and the Resident or their Representative for the provision of residential care services.

2. Acceptance of Terms

By engaging our services, submitting an inquiry, or entering into a residency agreement with Gentle Tides, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not proceed with residency or use of our services.

Residents must be 18 years of age or older. In cases where a resident lacks legal capacity, a legally authorized representative must accept these terms on their behalf.

3. Services Provided

Gentle Tides provides non-medical residential care services, including:

• Private or shared accommodation in a safe, comfortable environment
• Three freshly prepared meals per day with accommodation for dietary needs
• Personal care assistance with daily routines such as bathing, dressing, and mobility support
• Housekeeping, laundry, and general maintenance of living spaces
• Access to communal areas, gardens, and recreational facilities
• Cultural engagement and leisure programs, where applicable
• Medication management and reminders (not medical administration)

We do not provide medical or nursing care. Residents requiring skilled medical services should arrange such care independently with healthcare providers.

4. Admission and Residency

Admission to Gentle Tides is subject to availability and suitability assessment. We conduct an initial consultation to evaluate whether our services align with the prospective resident's needs. Admission may be declined if we determine that we cannot adequately meet the individual's care requirements.

Upon acceptance, a written Residency Agreement will be signed by the Resident or their authorized Representative. This agreement outlines the specific services to be provided, fees, payment terms, and any special arrangements.

5. Fees and Payment

Fees for residential care services are as follows:

• Tropical Garden Residency: ฿15,200 per month
• Cultural Engagement & Leisure Program: ฿13,500 per month
• Ocean View Villa Residence: ฿87,000 per month

Payments are due on the first day of each month and may be made by bank transfer or other agreed-upon methods. Late payments may incur a fee of 2% per month on the outstanding balance. Failure to pay fees within 30 days may result in suspension or termination of services.

Fees are subject to annual review and may be adjusted with 60 days' written notice to residents and their families.

6. Refund Policy

If a resident chooses to leave Gentle Tides, fees are refundable on a pro-rata basis for unused days in the current month, provided written notice is given at least 30 days in advance. No refunds will be issued for services already rendered or for deposits forfeited due to early termination without notice.

7. Resident Responsibilities

Residents and their Representatives agree to:

• Provide accurate and complete information regarding health, medical history, dietary needs, and personal preferences
• Treat staff, other residents, and visitors with respect and courtesy
• Follow house rules and safety guidelines to ensure a harmonious living environment
• Inform staff of any changes in health status, medications, or care needs
• Arrange for medical care and specialist consultations as needed, with our support in coordination
• Respect the privacy and property of others

8. Prohibited Conduct

The following behaviors are prohibited on the premises:

• Violent, abusive, or threatening behavior toward staff, residents, or visitors
• Harassment or discrimination based on race, gender, religion, nationality, or any other protected characteristic
• Possession or use of illegal substances
• Smoking in indoor areas (designated outdoor smoking areas may be provided)
• Actions that endanger the safety or wellbeing of others

Violation of these rules may result in termination of residency.

9. Termination of Residency

Residency may be terminated by either party under the following conditions:

By the Resident or Representative: Written notice of 30 days must be provided. Fees will be prorated for the notice period.

By Gentle Tides: We reserve the right to terminate residency with 30 days' notice if:

• The resident's care needs exceed our capacity to provide safe and adequate support
• There is a consistent failure to pay fees
• The resident engages in prohibited conduct or poses a risk to the safety of others
• We are required to cease operations due to legal or regulatory reasons

In emergency situations where immediate termination is necessary for safety reasons, notice may be waived.

10. Health and Medical Care

Gentle Tides provides personal care and support but is not a medical facility. Residents are responsible for arranging their own medical care, including consultations with doctors, specialists, and hospitals. We will coordinate with healthcare providers as needed and assist with medication reminders and appointments, but we do not administer medical treatments or nursing care.

In the event of a medical emergency, we will contact emergency services and notify the resident's designated family contact or representative.

11. Liability and Disclaimers

We take every reasonable precaution to ensure the safety and wellbeing of our residents. However, we cannot guarantee that accidents, injuries, or health complications will not occur. Gentle Tides is not liable for:

• Medical conditions, health deterioration, or injuries arising from pre-existing conditions or natural causes
• Loss or damage to personal property, unless caused by gross negligence on our part
• Actions or omissions of third-party healthcare providers or service vendors
• Consequences arising from a resident's failure to disclose accurate health information

Our liability for damages arising from our services is limited to the fees paid by the resident for the month in which the incident occurred.

12. Intellectual Property

All content on the Gentle Tides website, including text, images, logos, and design elements, is the property of Gentle Tides and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content from our website without prior written permission.

13. Privacy and Data Protection

Personal information collected and processed by Gentle Tides is handled in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as described in the Privacy Policy.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Thailand. Any disputes arising from or related to these terms or the provision of services shall be subject to the exclusive jurisdiction of the courts in Phuket, Thailand.

15. Dispute Resolution

In the event of a dispute, we encourage residents and their families to contact us directly to seek an amicable resolution. If informal resolution is not successful, either party may pursue mediation or legal proceedings as appropriate under Thai law.

16. Changes to Terms

We reserve the right to update these Terms and Conditions from time to time. Changes will be communicated to residents and their families by email or written notice, and the updated terms will be posted on our website with the revision date. Continued use of our services following notification of changes constitutes acceptance of the revised terms.

17. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
